Terms and Conditions
1. General
This website (hereinafter referred to as the “Site”) is a personal blog and simultaneously a Finnish online store selling plants and related products within the EU (excluding Switzerland and Norway). The Site is operated by Black Vortex Plants, business ID 3464573-9. These terms of service (hereinafter referred to as the “Terms”) apply to all orders made through the Site.
2. Orders and Acceptance
Orders are binding once they have been received and confirmed. We will confirm the order by email (“Your order has been confirmed”). We reserve the right to cancel the order if the product is unavailable or if there are errors in the product information or pricing.
3. Prices and Payments
All prices include value-added tax (VAT). Shipping costs are added to the total order amount at checkout. We accept the following payment methods: [list accepted payment methods, such as online banking, credit cards, PayPal]. Payment is charged at the time of the order.
4. Shipping
We ship orders to Finland and EU countries. Please note that it will take average of 7 business days from the order confirmation to collect, pack and ship the product. We strive to ship the products as soon as possible, but we are not responsible for delivery delays caused by third parties. Kindly note that as Black Vortex Plants isn’t a full-time business, there might be general delays with delivery. The customer will be informed about such delays.
5. Fresh Product Complaints
Plants are considered fresh products, and the customer has the right to file a complaint about the product within three (3) days of receipt. Complaints must be made by email to [email protected]. Please include photos of the damaged product and a description of what happened. We will do our best to find a way to fix your experience.
6. Return Policy and Refunds
The right to return plants is limited to three (3) days from receipt due to their nature as fresh products. Other products can be returned within 14 days of receipt, provided they are in their original condition and unused. The customer is responsible for return shipping costs. However, returns cannot be made if the customer has repotted, fertilized, or otherwise altered the plant within this three-day period, which might exacerbate the shock of changing the plant’s environment.
7. Liability
Before confirming your order, you will be offered the opportunity to inspect the current condition of the plant through photographic material. The customer accepts or rejects the product as presented. We pack the plants as well as we can, but we cannot compensate for damage caused by postal handling or delays. Please note that some plants, such as Alocasias, are very sensitive to even minor environmental changes. The plant may yellow a leaf, drop it, or otherwise appear temporarily unwell. This is normal, and the customer acknowledges the risks associated with ordering the plant.
8. Privacy
We collect and process customers’ personal data in accordance with our privacy policy, which can be found [link to privacy policy]. We use the data only for processing the order and maintaining the customer relationship.
9. User Obligations
The customer must provide accurate and up-to-date information when placing an order. The customer is responsible for ensuring that the delivery address is correct and that the products can be delivered safely.
10. Changes to the Terms
We reserve the right to change these Terms at any time. Changes take effect when they are published on the Site. We recommend checking the Terms regularly.
11. Applicable Law and Disputes
These Terms are governed by Finnish law. Any disputes will primarily be resolved through negotiation. If negotiations do not lead to a resolution, disputes will be handled in Finnish courts.
